LANCASTER ZONING BOARD OF ADJUSTMENT

JULY 26, 2006

 

CALL TO ORDER:

Chairman A. Savage called the meeting to order at 6:30 p.m.

 

ROLL CALL:

A. Savage, Chairman; J. Hammond, Vice Chair, regular; T. Frenette, alternate; A. Bouthillier, regular; S. Martin, regular 

 

Others present were Frank & Tanya Batchelder, Ed Samson and Charles Fitch III

 

Chairman Savage appointed T. Frenette as a full voting member for case #458.

 

Case #458 Frank & Tanya Batchelder for an area variance concerning article 5 section 5.01of the Zoning Ordinance.  Applicant requests to site an 18’ x 20’ addition closer than 15 feet from the right-of-way on Starr King Park in the Residential Zoning District. (13 Starr King Park; Tax Map P3 Lot 39).

 

Chairman Savage discussed with Frank & Tanya Batchelder their proposal of an 18’ x 20’ addition closer than 15 feet from the right of way on their property at 13 Starr King Park.  They affirmed that this is their intention.  There was discussion of a discrepancy of actual width of road surrounding the property.  The Registry of Deeds shows 50’ and the tax map appears to show 60’. A. Bouthillier mentioned that it would be best to go by the registry.  J. Hammond asked the Batchelders if they obtained a variance for the existing garage to which they answered yes.

 

Chairman Savage asked Charles Fitch III if he had any concerns regarding the addition.  Charles replied saying he did not feel it would harm the neighborhood and would not pose any problems as far as snowplowing either.

 

Chairman Savage mentioned that he spoke with Dennis Donnelly and he did not feel there would be a problem with road maintenance as far as the town was concerned. A. Savage then said he felt there should not be a problem granting the variance. 

 

Motion was made by S. Martin and seconded by A. Bouthillier to approve an area variance on lot 39 for Frank & Tanya Batchelder for an 8’ right-of-way to erect an addition on their house at 13 Starr King Park, Lancaster.

 

MOTION CARRIED – UNANIMOUS

 

Chairman Savage cautioned Frank & Tanya that the public has 20 days to appeal this decision so it would be wise to hold off starting addition prior to then.

 

OTHER BUSINESS

 

Chairman Savage questioned the board as to whether or not they wanted to elect officers at this meeting or wait for more members. 

 

Motion was made by S. Martin and seconded by A. Bouthillier to continue with A. Savage as Chairman and J. Hammond as Vice Chairman. 

 

MOTION CARRIED - UNANIMOUS

 

 

APPROVAL OF MINUTES

Motion was made by A. Savage and seconded by J. Hammond to approve the minutes of the January 29, 2006 meeting.

 

MOTION CARRIED - UNANIMOUS

 

Motion was made by T. Frenette and seconded by J. Hammond to adjourn the meeting at 6:45 p.m.

 

MOTION CARRIED – UNANIMOUS

 

Meeting was adjourned at 6:45 pm.
